TERMS & CONDITIONS

1. Description of Promotion:

   In this Promotion (the “Promotion”), which is governed by these terms and conditions (the “Terms and Conditions”), Eligible Customers (defined below) of LANDAUER (“Sponsor”) may enroll to receive a ninety (90) day Limited License (defined below) to the myLDR® Productivity Package, free of charge.

   The Productivity Package is an add-on to myLDR that empowers your team with real-time data analytics, automated ALARA threshold alerts, and ready-to-use compliance reports—reducing manual processes and administrative burden. The package components include:

   • RadFacts™: Quickly analyze your dosimetry data and prepare for Radiation Safety Committee meetings with RadFacts. This optional add-on for myLDR® provides the critical information you need, such as ALARA performance, collective dose, and fetal monitoring, all in one easy-to-use dashboard.
   • Signature Suite™: A compliance documentation upgrade for myLDR® that simplifies record-keeping for compliance purposes, enables digital signatures, reduces manual activities around reporting, and can save valuable time!
   • Equivalent Form 5 - Quarterly: Simplifies the process of documenting and reporting radiation dose information in a format consistent with regulatory requirements, saving you time and reducing administrative burden.
   • ALARA Service: ALARA Service is a completely digital workflow that simplifies the management of ALARA notifications, tracking, and record-keeping.
   • ALARA Recap - Quarterly: A comprehensive quarterly report that provides a summary of individual and collective exposure for your radiation safety program, helping you ensure adherence to ALARA principles and identify areas for improvement.

   Eligible Customers who enroll in this promotion shall receive a Limited License for ninety (90) calendar days of Productivity Package access from December 18 – March 18. Once granted, access will include full use of the package components. Use of the Limited License during the Promotion is subject to the myLDR Terms and Conditions (“myLDR Terms and Conditions”), located here: https://www.landauer.com/media/388 

   In the event that Eligible Customers already subscribe to one or more components of the Productivity Package, the remaining components will offered for free, and the pre-subscribed components will remain unaffected. Eligible Customers will continue to be charged for pre-subscribed components at their normal billing rate.

   These Promotion Terms and Conditions, together with the myLDR Terms and Conditions, are a binding contract between you and Sponsor regarding the Promotion.  By participating and enrolling, Eligible Customer agrees it has reviewed these Terms and Conditions and the myLDR Terms and Conditions, and agrees to be bound by them and satisfies all the eligibility requirements.

2. Eligibility:

   This Promotion is open only to Eligible Customers.

   For purposes of this Promotion, the term “Eligible Customer” means any existing customer of Sponsor located in the fifty (50) United States and the District of Columbia that, during the entire Promotion Period, meets the following conditions:

   1. Is a current LANDAUER Luxel®+ dosimetry customer utilizing myLDR 2.0;
   2. is not on contract with a member GPO that provides LANDAUER dosimetry services;
   3. is not on ordering hold with the Sponsor;
   4. has opted to participate in this Promotion and has agreed to its Terms and Conditions;

3. Promotion Period:

   The Promotion period starts at 12:00 AM US Pacific Time on December 18, 2025 and ends at 11:59 PM US Pacific Time on March 18, 2026 (the “Promotion Period”). US Pacific Time shall control for all purposes of the Promotion. 

4. Limited License 

   Subject to these Terms and Conditions, and the myLDR Terms and Conditions, Sponsor shall grant Eligible Customer a non-exclusive, non-transferable, non-sublicensable, limited license to use the myLDR Productivity Package solely for Eligible Customer’s internal business purposes for a period of ninety (90) days, free of charge (“Limited License”). This Limited License does not convey any ownership interest in the myLDR software or Productivity Package components, or any intellectual property rights therein.

5. Other Restrictions and Limitations of the Promotion:
   
   1. Pricing.   The Limited License shall be provided at no charge to Eligible Customer. This offer may only be redeemed once per Eligible Customer.
   2. License Termination. On March 18, 2026, the Limited License shall lapse and Eligible Customer shall lose access to the myLDR Productivity Package and its components. There will be no charge to Eligible Customer, and no automatic conversion of the Limited License into a paid license. Should Eligible Customer wish to continue its subscription and convert to a paid license, Eligible Customer must subscribe to the Productivity Package in myLDR via the Subscription Center.
   3. Data Download. Prior to termination of the Limited License, Eligible Customer shall be able to download any of its data during the Promotion Period. Upon termination of the Limited License, all of Eligible Customer’s data in the system shall be handled according to the myLDR Terms and Conditions.  After termination, Eligible Customer shall have access to any reports generated during the Promotion Period, but will be unable to generate new ones or use Productivity Package features and components they are not previously subscribed to.
   4. Productivity Package Components. If Eligible Customer is pre-subscribed to components included in the Productivity Package, then only the components they are not pre-subscribed to shall be included in the Limited License. Eligible Customer shall continue to pay for pre-subscribed components during the Promotion Period.

6. Instructions on How to Participate in the Promotion:

   To enter the Promotion and receive a Limited License, Eligible Customer must indicate its interest to the LANDAUER team at a relevant trade show at which the Promotion is offered and scan the indicated QR code. Eligible Customer must use the QR code link to provide its information and contact details, and digitally accept these Promotion Terms and Conditions. Once enrolled, Eligible Customer’s access will begin on December 18, 2025 and terminate on March 18, 2026.

7. Instructions on How to Disenroll or Cancel a Limited License:

   To disenroll from or cancel the Limited License, Eligible Customer must contact customer service by phone or email at 1-800-323-8830 or [email protected].

8. Release of Liability and Indemnification:

   Except where otherwise prohibited by law, by participating in the Promotion, Eligible Customer releases and agrees to indemnify and hold harmless Sponsor and each of its parent companies, subsidiaries, and affiliates, and each of their respective directors, officers, professional advisors, distributors, representatives, employees and agents (collectively, the “Released Parties”) from any liability, obligation, injury, claim, suit, action, cost, expense, loss or damage of any kind, including any tax liability or loss of opportunity, whether direct, indirect, special, incidental or consequential, that may be imposed on, asserted against or incurred by such Released Party that arise out of or relate in any way to the Promotion and the offers made hereunder, including, but not limited to, the following: (a) any technical difficulties or equipment malfunction (whether or not under Sponsor’s control); (b) any theft, unauthorized access or third party interference; (c) any tax liability incurred by Eligible Customer; (e) any errors in the Promotion Materials; or (f) use or misuse of the Limited License offered under the Promotion, as per the myLDR Terms and Conditions.

9. Miscellaneous:

   The Promotion and these Terms and Conditions will be governed, construed and interpreted under the laws of the State of Delaware without applying any conflicts or choice of law provisions under such law that might refer the construction or interpretation of any term hereof to the laws of any other territory or jurisdiction and any action brought regarding the Promotion and these Terms and Conditions may only be brought in the state or federal courts serving Delaware, and each party to such action expressly consents to jurisdiction of those courts.  If any provision of these Terms and Conditions is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and, provided that the fundamental terms and conditions of these Terms and Conditions remain legal and enforceable, the remainder of these Terms and Conditions shall remain operative and binding. 

   Eligible Customer is bound by these Terms and Conditions, the myLDR Terms and Conditions, and by the decisions of Sponsor, which are final and binding in all respects. To the extent permitted by law, Sponsor reserves the right to change these Terms and Conditions at any time, including, but not limited to suspension or cancellation of the Promotion or any Eligible Customer’s participation in the Promotion should computer viruses, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or conduct of the Promotion, Sponsor otherwise becomes (as determined in its sole and absolute discretion) incapable of conducting the Promotion as planned, or for any other reason determined by Sponsor to be appropriate in its sole and absolute discretion.

   These Terms and Conditions constitute the entire agreement governing the Promotion, and no other agreement, verbal or otherwise, shall be binding regarding the Promotion unless it is in writing and signed by Sponsor.  In case of any conflict or inconsistency between any other document relating to the Promotion and these Terms and Conditions, these Terms and Conditions shall control.  To the maximum extent provided by law, no waiver of any provision of these Terms and Conditions will be implied from any course of dealings between the Eligible Customer and Sponsor or from any failure by Eligible Customer or Sponsor to assert its rights hereunder on any occasion or a series of occasions. 

   Any Eligible Customer who violates these Terms and Conditions, violates any law, rule or regulation in connection with participation in the Promotion (in each case as determined in Sponsor’s sole and absolute discretion) is subject to disqualification from participation in the Promotion and all other rights and remedies available under the law.
